Custom design terms

1.Who these terms are between

These terms are between you and L3D Accessories, PO Box 150, Dursley, GL11 9DW, United Kingdom. In these terms, "custom work" means any jig, fixture, tray, bracket or associated design file made to your specification rather than sold from the standard catalogue.

Where you are buying as a consumer, nothing in these terms removes or limits your statutory rights. Where you are buying for the purposes of a business, some of your rights are different and this is set out in clause 13.

2.How the order is formed

An enquiry is not an order and places you under no obligation. After you enquire, you will receive a written quote setting out the specification, what you will receive, the price, and an indicative timescale.

A contract is formed only when you accept that quote and pay the invoice sent to you. Until payment is received, no design work begins and nothing is owed by either side.

The quoted price is fixed for the specification quoted. It will not change unless you change the specification, or unless information you supplied turns out to be materially inaccurate. In either case you will be told before any additional cost is incurred, and you may decline.

Quotes are valid for 30 days unless stated otherwise on the quote itself.

3.Information you supply

Custom work is designed from the measurements, photographs, drawings and machine details that you provide. You are responsible for the accuracy of that information.

If the finished jig does not fit because the information you supplied was inaccurate or incomplete, this is not a fault in the work. A revised version can be produced and will be quoted for separately.

Where possible, supplying the physical item for measurement gives the most accurate result. If you choose to post an item, it travels at your risk. It will be returned with your completed order unless you ask otherwise, and reasonable care will be taken of it, but you should not send anything irreplaceable.

4.Revisions and changes

Two rounds of revisions are included in the quoted price. A revision means an adjustment to fit, tolerance, or a minor feature within the agreed specification.

The following are not revisions and will be quoted as new work: changing the item the jig is designed to hold, changing the machine it is designed for, changing the quantity held per run, or adding features not described in the agreed specification.

5.Timescales

Timescales given in a quote are good faith estimates, not guarantees, unless a specific delivery date has been agreed in writing and confirmed on your quote.

If a deadline is critical to you, say so before you approve the quote so that it can be confirmed or declined honestly. Delays caused by waiting for information, photographs or items from you do not count towards the estimate.

6.Cancellation and refunds

Before work starts

You may cancel at any point before design work begins and receive a full refund. Contact chris@l3daccessories.com as soon as possible.

After work starts

Because custom work is made to your specification and is clearly personalised to your job, the 14 day right to change your mind under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply. This is a specific exemption in those regulations for goods made to a consumer's specification.

By approving a quote you acknowledge that you have been told this before purchase.

Design files

Where the custom work is supplied as a digital file, you agree that supply begins immediately on delivery of the file and you acknowledge that you lose any right to cancel once the file has been sent to you.

If something is wrong

None of the above affects your rights if the work is faulty, not as described, or does not match the agreed specification. In that case it will be corrected, or refunded, in line with your statutory rights.

7.Intellectual property and your licence

All intellectual property in custom work, including the design, the model and any files supplied, remains the property of L3D Accessories.

You are granted a perpetual, worldwide, non-exclusive licence to:

• Use the jig, and print the file, for your own production, including commercial production.
• Sell items that you make using the jig, without any royalty or further payment.
• Print replacement copies for your own use as often as you need.

The licence does not permit you to:

• Sell, share, publish, lend or otherwise distribute the design file to anyone else, whether free or paid.
• Sell printed copies of the jig itself as a product.
• Reverse engineer the file in order to produce a derivative design for distribution.

If your intended use goes beyond this licence, for example if you want to resell the jig as a product in your own range, say so at enquiry stage and a suitable licence will be quoted.

8.Reuse of the design

Unless you have purchased exclusivity, L3D Accessories may produce and sell a general version of a custom design as part of the standard range.

Any such version will not include your business name, your branding, or any element specific to your business, and your identity as the original customer will not be disclosed.

If you need a design kept exclusive to you, request this before approving the quote. Exclusivity is available as a paid option and, where agreed, will be stated in writing on your quote.

9.Third party rights in what you send

If you supply a logo, artwork, branded item or any other third party material, you confirm that you own it or have permission to use it for the purpose requested.

L3D Accessories will not verify ownership and accepts no responsibility for infringement arising from material you supply. You agree to cover any loss, claim or cost that arises from a third party asserting rights over material you provided.

Work that appears to infringe a third party's rights may be declined at any stage. Where work is declined before it begins, any payment already made is refunded in full.

10.Use of the jig, and safety

A jig is a positioning aid. It is not a safety device, a guard, or a substitute for the safety features and operating instructions of your machine.

You remain responsible for operating your machine safely, for extraction and ventilation, for the suitability of the materials you engrave or cut, and for running a framing or alignment pass before each job.

Custom work is designed for the machine and the item described in the agreed specification. No representation is made about its suitability for any other machine, material or purpose.

Printed jigs are made from 3D printed plastic. They are consumable items and will wear with heat, use and time. They are not intended to be permanent tooling.

11.Delivery of physical items

Where your order includes a printed jig, it will be dispatched using the shop's standard shipping options and to the same destinations. Delivery timescales, charges and duties are as set out in the shop's shipping information.

Custom physical items supplied to customers in the European Union are accompanied by the same product safety and manufacturer information as standard catalogue items.

Risk in a physical item passes to you on delivery.

12.Payment, price and VAT

Payment is taken through the shop's normal checkout using the invoice link sent to you. Design work begins once payment has cleared.

Prices are quoted in the currency shown on your quote and include VAT where it applies. Where a printed jig is included, the print and postage element is shown separately on the quote.

Where a job is quoted in stages, each stage is invoiced and paid before that stage begins.

13.Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, total liability in connection with any custom work is limited to the amount you paid for that work.

Where you are buying for business purposes, there is no liability for loss of profit, loss of production, wasted material, wasted machine time, or any indirect or consequential loss.

Where you are buying as a consumer, this clause does not affect your statutory rights, and liability for foreseeable loss caused by a failure to use reasonable care and skill is not excluded.

14.Your information

Details, photographs and measurements you supply are used to quote and produce your work, and are kept as part of the order record. They are not shared with anyone else except where necessary to fulfil your order. The shop's privacy policy sets out the rest.

Photographs of finished custom work may occasionally be used to show what the service can do. If you would rather your work was not shown, say so and it will not be. Nothing that identifies you or your business is ever published without your agreement.

15.Changes to these terms

These terms may be updated from time to time. The version that applies to your order is the version published at the time you approved your quote. Changes are not applied retrospectively.

16.Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

If you are a consumer resident elsewhere, this does not deprive you of the protection of any mandatory consumer law that applies in your country of residence.
